Colorado Supreme Court Rules Against Municipal Fracking Bans

The efforts of some cities in Colorado to create rules and regulations against oil and gas development, including fracking have been shot down by the Colorado Supreme Court. The Justices ruled this week state power trumps the local bans on oil and gas drilling near cities.

The ruling involved a challenge of a five-year moratorium on fracking implemented by the city of Fort Collins. Similar efforts started last year in Oklahoma but the legislature quickly created a state law in opposition to such bans. The Supreme Court also rejected a 2012 ban bv the city of Longmont to ban fracking and the disposal of fracking waste in the city because it “materially impedes” state power, according to a report in the Denver Post.
